Today's announcement by the U.S. Ninth Circuit Court of Appeals to rehear its ruling on the Kamehameha School was applauded by Senator J. Kalani English (D-Hana, East and Upcountry Maui, Moloka'i, Lana'i, and Kaho'olawe). Sen. English, a graduate of the Kamehameha Schools, is one of two Native Hawaiian members of the State Senate.
"I am glad the Ninth Circuit judges have decided to review their August 2 decision," Sen. English said today. "An en banc review of the decision by a panel of 15 judges will provide a framework for a comprehensive review of a decision that affects everyone in Hawai'i.
"It was a mistake for the court to place a narrow construction on the Kamehameha School admissions policy. I am confident that the appeals judges will recognize the importance of protecting the school's unique legacy.
"This is about honoring the wishes of the last member of the Kamehameha Dynasty and understanding her goals for the children of Hawai'i. By deciding to review their August decision, the judges have shown an understanding that this is a complex issue - and that the legacy of Princess Bernice Pauahi Bishop, and her goals for the children of Hawaii, are worthy of careful consideration."
From Governor Lingle:
"Courts ought to be instruments of justice, not of injustice. I am glad the State was able to help Kamehameha Schools obtain this decision to have the full Court of Appeals review this matter, and I remain hopeful that Kamehameha Schools will ultimately win this case which is of such great importance to Hawai`i and our citizens, Hawaiian and non-Hawaiian alike."
Attorney General Mark Bennett stated:
"I am very happy at the Ninth Circuit's decision to rehear this matter en banc. I believe the original panel decision was legally flawed and manifestly unjust. I look forward to working with the Kamehameha Schools to prepare the best possible case to present to the en banc court."
